Alfred Kwabena Asiedu, the former Jasikan Circuit Court judge, who was dismissed over alleged misconduct, has filed a lawsuit against the Judicial Service and Chief Justice Gertrude Torkornoo challenging his removal.
He is seeking a legal declaration asserting that his removal was unlawful. Among the reliefs sought, he requests a declaration that the act of removing him from the position of Circuit Court judge, as stated in the letter signed by the Chief Justice on November 13, 2023, is illegal.
Additionally, he seeks a declaration that both the Disciplinary Committee and the Judicial Council exceeded their authority when they concluded that he engaged in malicious prosecution, contending that these findings are glaring legal errors evident on the record and should be nullified through the supervisory powers of the court.
Background:
Chief Justice Gertrude Torkornoo terminated Alfred Kwabena Asiedu from his role as a result of misconduct in a divorce case he presided over. The disciplinary committee, which investigated allegations of an improper relationship with a woman involved in the divorce petition, found him culpable. Singari Diana Sadia presented a petition on January 16, 2023, accusing Justice Asiedu of abuse of power, sexual exploitation, malicious prosecution, and impropriety.
Upon receiving the petition, the Chief Justice forwarded it to the Judiciary Service’s disciplinary committee for investigation. Following a thorough examination, the committee recommended Justice Asiedu’s dismissal. In a letter dated November 13, 2023, Justice Torkornoo conveyed the decision, stating that the Disciplinary Committee found evidence of misconduct, including an improper relationship with the petitioner and abuse of power, leading to the recommendation for dismissal.
