The property dispute between former Black Stars captain Asamoah Gyan and his ex-wife Gifty Gyan has been resolved by the Accra High Court. Asamoah Gyan filed a court petition to have the marriage dissolved, and the marriage has now been dissolved.
Following a successful DNA test, the findings showed that each child was Asamoah Gyan’s biological child.
Gifty Gyan now has the right to a gas station, two cars, a 4-bedroom home at Spintex in Accra, and a house in the United Kingdom.
Under the direction of Hafisata Ameleboba JA, the court determined that Gifty’s significant contribution qualified her for a portion of Asamoah Gyan’s estate.
The court determined that Gifty was entitled to a share of the properties because she was the only one who lived with the children and provided for them while Asamoah Gyan, the petitioner, worked. As a result, the court awarded Gifty two cars, a gas station in Prampath, a four-bedroom house in Spintex that she had already bought before getting married in 2013, and a property in the UK.
In its ruling, the court determined that, based on the evidence, Gifty’s paper marriage which took place in 2002 when she was 17 years old, was not grounds for annulment and that the marriage was still in effect.
As a result, a nullity decree was issued, nullifying the 2013 marriage between Asamoah Gyan and Gifty Gyan.
The court further held that the parties had two children together before deciding to formally formalize their union through ordinance marriage, as evidenced by the uncontested evidence in the record, which indicates that the parties had been in an amorous relationship since 2003.
Regarding her substantial contribution for a share in Asamoah Gyan’s property, the court determined that she was entitled to a share because she had helped to acquire the properties in kind by being the only one to care for the children and live with them while the petitioner practiced his trade. She was thus given a UK property, a gas station in Prampath, a four-bedroom house in Spintex that she had already bought before getting married in 2013, and two cars.
