The injunction motion that was granted to prevent the late Ga Manye’s burial from taking place has been overturned by an Accra High Court.
In its decision, the court stated that the applicants’ failure to disclose the actual situation to the court resulted in the injunction application being granted in error.
“Any party wishing to move on with any action must serve the other party,” according to presiding court judge, Justice Patrick Baayeh.
He also stated that “After reviewing the applicants’ affidavit, which was testified to by the first defendant/applicant, and after speaking with Ayikoi Otoo ESQ, the Defendants’/Applicants’ counsel, I believe that the Order of Interim Injunction that was given on October 25, 2023, was made incorrectly. The court was not informed of the genuine situation by the applicants.”
“In fairness to the parties, therefore, the Order of Interim Injunction granted on 25th October 2023 is hereby set aside. Any party desirous of proceeding may come on notice to the other party for proper evaluation of the evidence from both sides.”
Justice Patrick Baayeh concluded “I make no order as to cost.”
